This website (the “Site”) is operated by Mario Muscariello LLC, a Florida Limited Liability Company, with its principal office located at:

Mario Muscariello LLC (“the Company”) acts as the exclusive distributor for the Americas of goods branded “Mario Muscariello”, produced primarily in Italy and owned by Mario Muscariello International, an entity based in Europe. The Company operates mainly on a wholesale basis (B2B) in the United States and provides both wholesale (B2B) and retail (B2C) distribution in other countries of the American continent, excluding the United States.

2. Scope of Use

The Site serves only a promotional and informational function. It does not enable direct e-commerce transactions. No direct online purchases or payments can be completed through the Site. Any transaction is to be considered a remote negotiation for made-to-order goods and shall not constitute an online sale under U.S. law. Each item is made specifically for the client, whether a business or an individual.

3. Nature of Orders

Due to the custom-made nature of the goods, returns and cancellations are not permitted unless explicitly authorized in writing by the Company. The Company reserves the right to reject return requests if they do not meet quality control and eligibility requirements.

4. Recommended Retail Prices and Retail Sales

The prices displayed on the Site are suggested retail prices for resellers only.
Mario Muscariello LLC does not engage in direct retail sales within the State of Florida, and therefore, does not collect nor remit sales tax in Florida.

Retail sales in the Miami area are handled exclusively by:
Artigiano Inc. – 4212 Lagura Street, Coral Gables, FL 33146,
which is the exclusive authorized retailer for the region.
Retail transactions are processed directly by authorized resellers, who assume all legal, fiscal, and contractual obligations regarding the sale.

5. Sales Outside the United States (Export Policy)

For B2C sales conducted outside the United States but within the American continent, Mario Muscariello LLC operates under Incoterm CPT (Carriage Paid To).

This means:

• The customer is solely responsible for the payment of import duties, customs fees, and any applicable taxes in their country.

• Mario Muscariello LLC is not liable for customs clearance or tax compliance outside the U.S.

• The Company remains responsible only for the quality of the goods delivered.

6. Consultancy and Commercial Representation Services

Mario Muscariello LLC also provides strategic consulting and support services, including:

• Product development and sourcing assistance

• Styling and branding consultancy

• Business strategy and market expansion

• Import advisory services for U.S. entry of European-made goods

• Commercial representation, for which the Company receives commissions on wholesale transactions.

These services are available to both corporate clients (B2B) and individual entrepreneurs (B2C) seeking to start or grow a business.

7. Trademarks and Copyright

“MARIO MUSCARIELLO” is a registered trademark in multiple jurisdictions, including the United States. All content on the Site, including images, artworks, and written materials, is protected under U.S. Copyright Law and may not be used, reproduced, or distributed without prior written consent.

8. No Right to Resell

You may not purchase, inquire about, or engage with the Company’s products or services for the purpose of resale without express prior written authorization. Resale or redistribution of any items without such approval constitutes a violation of these Terms.

9. Limitation of Liability

The Site is provided “as is” and “as available”. The Company makes no guarantees that the Site will be error-free, uninterrupted, or virus-free.
